Collection of information

We collect personal information from you, including information about your:

  • name,
  • contact information,
  • health information relevant to your assessment and care,
  • and, billing or purchase information.

As part of your clinical assessment, we may also collect movement analysis data using MotionTrak powered by the HumanTrak 3D motion capture system. This may include:

  • Video recordings of guided movements
  • Joint angle measurements and range of motion data
  • Postural and symmetry analysis
  • Functional movement metrics

This information forms part of your clinical health record. We collect your personal and health information directly from you unless otherwise authorised or required by law.

Use of information

The information you provide is used in accordance with our obligations under the Privacy Act 2020 and the Health Information Privacy Code 2020 for:

  • Your assessment, treatment, and ongoing care
  • Movement analysis and rehabilitation planning (where applicable)
  • Liaising with other healthcare providers and ACC as authorised by you
  • Monitoring and improving the provision of our services
  • Providing information you request
  • Responding to queries or concerns
  • Administering financial and practice records

Except as described in this Privacy Policy, Chiro Instinct will not share, sell, or rent your personal information without your permission unless required or authorised by law.

Sharing of information

Besides our staff, we share relevant personal information with the following third-party service providers for the purposes of delivering your care:

  • Nookal – our practice management software provider.
  • VALD – provider of the HumanTrak motion analysis platform.
  • Accident Compensation Corporation (ACC), where applicable.

MotionTrak data is stored within VALD’s secure cloud-based system. Electronic data may be stored on secure servers located outside New Zealand. Where information is stored overseas, we take reasonable steps to ensure it is protected in a manner consistent with New Zealand privacy law.

We only provide access to personal information to third-party services strictly for the purposes for which they are engaged and require them to maintain appropriate security safeguards.

Identifiable video recordings or movement data will not be used for marketing, research, or publication without your separate written consent.

De-identified data (which does not identify you) may be used for internal audit, service improvement, benchmarking, or educational purposes.

Storage of information

Your information is stored securely using electronic practice management and clinical systems with appropriate safeguards in place to protect against loss, unauthorised access, misuse, or disclosure.

We are required to retain health information for a minimum of 10 years after your last consultation, in accordance with the Health (Retention of Health Information) Regulations 1996.

Access to information and correction

You have the right to ask for a copy of any personal or health information we hold about you, and to ask for it to be corrected if you believe it is inaccurate. If you’d like to ask for a copy of your information, or to have it corrected, please contact us at hello@chiroinstinct.co.nz.
